Terms & Conditions

Welcome to dailybritain.co.uk. These Terms cover your use of the Daily Britain website and app, together with any further terms we apply to specific services (the "Site" and the "Terms"). Using the Site in any way, on any device, or setting up an account or signing up for our emails, means you accept these Terms. If you would rather not accept them, please do not use the Site.

1. About us

The Site is operated by Daily Britain Media LLC ("we", "us" or "our"), a limited liability company registered in Wyoming, United States, with our principal office at 1309 Coffeen Avenue STE 1200, Sheridan, WY 82801, United States. You can contact us at support@dailybritain.co.uk.

2. Changes to these Terms

We may change these Terms at any time. Any change takes effect as soon as it is posted to the Site. As such, we recommend you check this page from time to time. Continuing to use the Site after a change means you accept the revised Terms. Where a change materially affects a paid membership you already hold, we will tell you by email at least 30 days before it takes effect.

3. Registration and your account

Some areas of the Site, and our email services, are open only to registered users. If you register, or are given a password, you must keep your login details confidential and must not share them with anyone else. You are responsible for all activity that takes place under your account. Tell us straight away at support@dailybritain.co.uk if you think someone else has accessed your account.

4. Use of the Site

4.1. "Content" means everything we publish or make available through the Site, including articles, text, images, graphics, page design, logos, audio, video, data and software. "Trade Marks" means the brand names, logos and service marks we use on the Site, whether or not they are registered.

4.2. The Site, the Content and the Trade Marks belong to us or are used by us under licence, and all intellectual property rights in them rest with us or our licensors. Where part of the Site is reserved for members, that licence applies only for as long as your membership is active.

4.3. When using the Site you must: comply with all applicable laws; not use a false identity or another person's account; not deep-link to, frame or reproduce any part of the Site without our written consent; not modify, copy, scrape, harvest or attempt to extract the Content other than as these Terms allow, including by automated means for the training of artificial intelligence models except where we have expressly permitted it; not try to gain unauthorised access to the Site or any connected system; and not upload or transmit anything that is unlawful, defamatory, obscene, threatening, abusive, infringing, or that contains viruses or other harmful code.

4.4. Except as set out in the licence at clause 4.2, or as the law requires, you may not use, reproduce, copy, sell, republish or otherwise exploit any Content, Trade Mark or other part of the Site, in whole or in part, without our prior written consent. In particular, you may not republish our journalism on another website, in print, or as part of any commercial service. For permission or licensing enquiries, email support@dailybritain.co.uk.

4.5. We may, at any time and without notice, suspend or withdraw all or part of the Site, remove or edit any Content, or suspend or close your account, where we reasonably believe you have breached these Terms or where we need to for legal, security or operational reasons. Where we do so and you hold a paid membership, clause 8 sets out what happens to your payments.

5. Comments and material you submit

5.1. Where the Site lets you submit material, such as reader comments, letters, tips or contributions, you must make sure it is your own work, is accurate, and is not unlawful, defamatory, abusive, infringing or otherwise in breach of clause 4.3.

5.2. You grant us a royalty-free, worldwide, non-exclusive, perpetual licence to use, edit, copy, publish and distribute any material you submit, in any format and medium, including archiving it on the Site. We do not have to publish anything you send, and we may edit or remove it at any time without notice.

5.3. You agree we may disclose your identity to any third party who claims that material you submitted infringes their rights or breaks the law. You waive any moral rights in the material you submit.

6. Membership and subscriptions

6.1. Some Content and features are reserved for paying members. This clause 6, together with clauses 7 and 8, governs paid membership. Membership numbers may be limited; availability and member benefits are as described at the point of sign-up.

6.2. Founding Membership. Founding Membership costs £3.50 per month, billed monthly in advance by recurring card payment through our payment provider, Stripe, and renews automatically each month. Founding Membership is limited to the first 20,000 founding members. There is no minimum term: you can cancel at any time under clause 8.2. Founding Membership gives you access to member Content and features as described at the point of sign-up.

6.3. The equity element. Founding Membership includes eligibility for the founding subscriber equity scheme. That scheme is offered separately and is governed solely by the Subscriber Equity Agreement, including its eligibility, continuous-subscription and identity verification requirements, which will be provided to you before you commit to it. Eligibility depends on maintaining a continuous paid subscription for the period set out in that agreement; cancelling or allowing your membership to lapse may mean you forfeit any entitlement under the scheme. Units in the Company are not guaranteed to have any value and their value may be nil. Nothing on the Site or in these Terms is an offer of, invitation to acquire, or inducement to invest in any shares, units or securities, and the description of Founding Membership on the Site is not intended to be relied upon when making any investment decision.

6.4. Renewal. Your membership renews automatically each month unless you cancel. If the price changes, clause 7.3 applies.

7. Payment

7.1. Prices are shown in pounds sterling and include any applicable taxes. You authorise us, or our payment provider, to charge your chosen payment method for each monthly payment as it falls due until your membership ends.

7.2. If a payment fails, we may retry it and may suspend your access to member Content until payment is received. If payment is not received, your membership may end. Please note that a lapse in payment may affect your eligibility under the Subscriber Equity Agreement.

7.3. We may change membership prices. We will give you at least 30 days' notice by email before a change takes effect. If you do not want to continue at a new price, you may cancel with effect from the date it would apply.

8. Cancellation and refunds

8.1. 14-day cooling-off period. If you are a consumer, you normally have 14 days from the day you take out your membership to cancel and receive a refund. Where your membership gives immediate access to digital Content, you agree, at sign-up, that we may start providing that Content straight away, and you acknowledge that once you have started accessing it you lose the right to cancel for a refund during the cooling-off period.

8.2. Cancelling. You can cancel at any time using the cancellation option in your account settings or by contacting support@dailybritain.co.uk. Cancellation takes effect at the end of the monthly billing period you have already paid for, and you will not be charged again. We do not refund partial months. Please note: eligibility for the founding subscriber equity scheme depends on maintaining a continuous paid subscription as set out in the Subscriber Equity Agreement, so if you cancel you may forfeit any entitlement under that scheme.

8.3. Refunds. Outside the 14-day cooling-off period, refunds are at our discretion and are not normally given. We will refund you where we are at fault, or where the law requires it. Nothing in this clause affects your statutory rights as a consumer.

9. Data protection and privacy

We explain how we collect, use and protect your personal data, and how we use cookies, in our Privacy Policy, which includes our full cookie information. By using the Site you confirm you have read it.

10. Advertising and third-party links

10.1. Parts of the Site carry advertising and sponsored content. Advertisers and sponsors are responsible for making sure their material meets all legal and regulatory requirements. Any concern about an advertisement should be raised with the advertiser.

10.2. The Site may link to third-party websites. We are not responsible for those sites or their content, and any use of them is at your own risk.

11. Our liability

11.1. The Site and its Content are provided on an "as is" basis. To the fullest extent the law allows, we make no warranties about the accuracy, completeness or availability of the Site or the Content, and our journalism and any data on the Site are provided for general information, not as investment, legal, tax or other professional advice.

11.2. We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not liable for any indirect or consequential loss, loss of profit or opportunity, or loss of data, arising from your use of, or inability to use, the Site, and our total liability to any member is limited to the amounts that member has paid us in the twelve months before the claim arose. Nothing in this clause affects your statutory rights as a consumer.

12. General

12.1. If any part of these Terms is found to be unenforceable, the rest remains in force.

12.2. Our failure to enforce a right is not a waiver of that right.

12.3. These Terms are the entire agreement between us about your use of the Site and supersede any earlier understanding.

12.4. These Terms do not give any third party any right to enforce them.

12.5. These Terms, and any dispute arising from them or your use of the Site, are governed by the laws of the State of Wyoming, United States. If you are a consumer resident in the United Kingdom, you also benefit from any mandatory protections of UK law, and nothing in these Terms takes those protections away or prevents you bringing proceedings in your local courts where the law gives you that right.
